Community service will refer to services the court provides to offenders instead of imprisonment. While some activities may qualify as community service, others will not. You'll notice that there are quite a few court community service requirements. Here’s a closer look at what counts as court community service.
Court Community Services
The court system has a unique way of engaging with community members. It includes the program required to get an offender into the community called "Community Service." Community service hours can generally be placed in one of four different categories:
Program Hours - completed voluntarily by a defendant by volunteering your time for the benefit of organizations or groups providing services for the public.
Probation Conditions - these are conditions imposed by the court that provide a defendant with a specific amount and type of community service work hours court ordered as part of the convict's sentence.
Pre-Trial Services - it's completed before trial by defendants who are granted reasonable opportunity to reach an agreement on appropriate sentence levels based on individual circumstances, including such factors as employment history and family support systems.
Sentencing – sentences imposed through case-specific sentencing procedures promulgated by each state's legislature, implemented under the criminal appeals process, or at a federal level through federal sentencing policy decisions made by U.S. attorneys general or members of Congress.
What Counts as Community Services
In most states, there are several kinds of community services that are available to court-ordered offenders:
Community work programs
Volunteering for a charity or non-profit organization is considered a community service. Community service may include helping with clean-up efforts after natural disasters such as hurricanes or tornadoes, helping people who are homeless or otherwise impoverished, providing counseling services for victims of domestic violence, and other types of assistance to people in need. The Supreme Court has ruled that these activities count as court community service because they help people and improve lives without actually punishing someone for the actions done.
Substance Abuse Programs
Suppose you have been convicted of a drug-related crime such as possession or distribution. In that case, community service could involve working with substance abuse programs to help addicts overcome drug addictions and avoid repeating the same mistakes.
Connection between the Service and Crime
When it comes to court community service, you are often instructed not to do anything that will put your safety, health, or the safety of others in jeopardy. It can mean that you cannot be asked to work in a dangerous environment or on dangerous machinery.
Not For Serious Crimes
If you have committed a serious crime, there is no need for court community service because a prison sentence would serve that purpose much better than serving time in the community.
Suppose you have committed a minor crime such as shoplifting or vandalism. In that case, there might be some value in completing this type of sentence because it will help improve your behavior in the future and prevent further crimes from happening.
You might be required to complete the community service hours court-ordered within one year of being sentenced or by a specified date. It is called an accelerated program, which means that instead of waiting for the full term of your sentence, you will complete your community service hours in less than one year.
Sometimes, the best way to understand what counts as court-approved community service is to visit the courts themselves. You can talk with a representative who will give you detailed information about what needs to be done and how you can accomplish it.
