As a designer, I carefully explain to my clients that, while I am happy to use inexpensive clipart images on their sign or brochure or other projects to dress them up, they do not own the image. Their competitors may use the same exact image in their advertising as well. Further, I never use off-the-shelf or premade images for logo design. Legitimate logo designs should be custom made and exclusively ownable by the client, and, qualify for protection by trademark law. If a company’s competitor uses a confusingly similar mark, the company should then have recourse in court to force the competitor to stop using the mark (such court order is called an injunction) and may even be awarded for financial damages.
