Persons often process information through some of the same filters around and over again. We contact these filters "cognitive DraftKing arbitration ." They are hardwired in to our brains.
One of these simple biases is known as "simple attribution error." When anything great occurs, we often overestimate the role of our personal effort and intention. For instance, a shop manager might claim, "The changes I made helped us make more money this past year," though it occurred at the time the entire industry was expanding. On one other hand, when something bad occurs, we're persuaded to allocate blame. For example, "I understand his job was reduce when the organization was downsizing, but if he had set more effort in, they'd have held him and allow someone else go." In other words, although persons might think they origin for the underdog, they actually are inclined to congratulate themselves and responsibility the alleged victim.
In a contested matter, the complainant has been unhappy enough with the outcome of a situation to create a claim. At some level, the arbitrator should be careful not to have a tendency toward accusing the alleged victim or respond to his bias by overcompensating and only the alleged victim. Similarly, she must be cautious maybe not to truly have a bias toward crediting accomplishment solely to the effort and standard superiority of the celebration claiming accomplishment (although he may need to recognize that success in evaluating the evidence). She must be conscious of how he's answering at a unconscious level.
The advocate in arbitration can use cognitive biases in his favor by how he moves the story he tells. As an example, defendant's counsel can provide evidence of the many methods the plaintiff failed to take action to avoid or ameliorate the harm. While the supporter works the chance of alienating an arbitrator by reiterating evidence too much, she should truly make an effort to bolster the arbitrator's refined predilection toward accepting problem (and also character flaw). Furthermore, plaintiff's supporter should consider ways to damage the other side's refined statements of moral superiority. Counsel must plant the seeds of the black part of a successful defendant's story, like defendant were a baseball player who was viewed as a hero because of his expertise on the subject till people learned about his key steroid use.
While essential attribution mistake comes up more regularly as an obstacle to mediated resolution, the attentive advocate may also put it to use to simply help be persuasive in arbitration.
